This will let first time offenders for simple possession charges out of prison and make more room for for real criminals as well as reduce the overcrowding in our state and federal prison systems. The National Criminal Justice Act of 2009
Introduced Apr 17th, 2009 H.R. 5843, an act to Remove Federal Penalties for the Personal Use of Marijuana by Responsible Adults. Would also make room in prisons for Real criminals.
H.R. 5843 would eliminate penalties for the possession of marijuana for personal use, or for the not-for-profit transfer between adults of marijuana for personal use. Under the bill, possession of 100 grams (3.52 oz) or less of marijuana is presumed to be for personal use, as well as the not-for-profit transfer of one ounce or less of marijuana. The bill makes an exception that the civil penalty provided in the Controlled Substances Act may be imposed for the public use of marijuana if the amount of the penalty does not exceed $100.
Currently, this bill is under review by the House Committees on the Judiciary and Energy & Commerce.
